Legal Background and Questions Concerning the Federal Government’s Contractual Obligations Under the “Standard Contracts” with “Utilities”
This Memorandum analyzes issues related to the Standard Contract between the U.S. Department of Energy (“DOE”) and the “utilities.” Beginning with a discussion of specific provisions of the Standard Contract, this Memorandum then analyzes the status of lawsuits involving the Standard Contract, reviews issues related to on-site storage of spent fuel and HLW, and assesses the prospects for modifying the current waste-disposal regime through Federal legislation or amendments to the Standard Contract.

over the last three decades, with a current rate of about three million per year. The majority of

In July 1999, the U.S. Nuclear Regulatory Commission (NRC) Spent Fuel Project Office
(SFPO) issued Interim Staff Guidance 8 Revision 1 (ISG8R1) to provide recommendations for the use
of burnup credit in storage and transport of pressurized-water reactor (PWR) spent fuel. Subsequent to
the issuance of ISG8R1, the NRC Office of Regulatory Research (RES) has directed an effort to
investigate the technical basis for extending the criteria and recommendations of ISG8R1 to allow

The American Nuclear Society (ANS) appreciates the opportunity to comment on the draft Nuclear Waste Administration Act (NWAA). The ANS is a not-for-profit, international, scientific, and educational organization with nearly 12,000 members worldwide. The core purpose of ANS is to promote awareness and understanding of the application of nuclear science and technology. As an organization, it has published a number of position statements regarding the issue of spent fuel and radioactive waste.

End Effect keff Cias Curve for Actinide-Only Burnup Credit Casks
A conservative end effect keff bias curve for actinide-only burnup credit casks is presented
in this paper. Rather than performing axially burnup-dependent analysis, cask designers can, if
they choose to, analyze casks with a uniform axial burnup (at assembly average burnup value) and
add the keff bias values to conservatively bound the actinide-only end effect. Earlier studies
suggested 1-3% increase in keff to account for the end effect, but they included fission products
as well as actinides for their analyses.

Transportation Planning and Execution: Commercial Spent Nuclear Fuel
There have been roughly 2,600 shipments of commercial spent fuel in this country over the past three decades or so. Although this is not an enormous volume by European standards, it is nevertheless significant. These shipments fall into two general categories: individual and "campaign."
There have been a number of individual shipments where lead test assembly fuel was shipped from a reactor to a laboratory for examination. This is an important part of reactor fuel development.

ANS Position Statement: Creation of an Independent Entity to Manage U.S. Used Nuclear Fuel
It is increasingly apparent that the United States will require a large expansion of nuclear power
generation capacity to meet its future baseload electricity needs while reducing greenhouse gas
emissions. As a result, Congress and the Administration must act to update U.S. nuclear fuel
cycle policy to address these realities. This will likely require a multifaceted approach involving
some combination of on-site/centralized dry cask interim storage, nuclear fuel recycling, and
emplacement of high-level wastes in long-term geological storage.
