The Nuclear Energy Institute, on behalf of the nuclear energy industry, is pleased to provide comments on the discussion draft of the Nuclear Waste Administration Act of 2013 and the associated documents that were released on April 25.

As we work to complete our final recommendations to the Secretary by January 29, 2012,
we have determined that our efforts would be aided by the formation of an ad hoc
subcommittee to investigate the issue of co‐mingling of defense and commercial wastes.
Specifically, the ad hoc subcommittee would review and make a recommendation to the
Commission on the issue of whether the 1985 Presidential decision to co‐mingle defense
and commercial wastes for disposal should be revisited in light of changes that have

Dear Co‐Chairs and Members of the Joint Select Committee: The Blue Ribbon Commission on America’s Nuclear Future was established by the Secretary of Energy at the direction of the President to review policies for managing the back end of the nuclear fuel cycle and recommend a new strategy. We are pleased to be serving as Co‐Chairmen of the Commission, and we are writing to you to highlight an important action we believe should be reflected in your Committee’s baseline budget projections as you craft a bipartisan plan for reducing the national budget deficit.

The American Nuclear Society (ANS) appreciates the opportunity to comment on the draft Nuclear Waste Administration Act (NWAA). The ANS is a not-for-profit, international, scientific, and educational organization with nearly 12,000 members worldwide. The core purpose of ANS is to promote awareness and understanding of the application of nuclear science and technology. As an organization, it has published a number of position statements regarding the issue of spent fuel and radioactive waste.

The American Nuclear Society (ANS) supports the safe, controlled, licensed, and regulated interim
storage of used nuclear fuel (UNF) (irradiated, spent fuel from a nuclear power reactor) until disposition
can be determined and completed. ANS supports the U.S. Nuclear Regulatory Commission’s (NRC’s)
determination that “spent fuel generated in any reactor can be stored safely and without significant
environmental impacts for at least 30 years beyond the licensed life for operation.

Consistent with the mandate issued by the United States Court of Appeals for the District of Columbia Circuit in National Association of Regulatory Utility Commissioners v. United States Department of Energy, (Nos. 11-1066 and 11-1068; D.C. Cir. 2013), and notwithstanding the absence of the determination required to be made pursuant to the Nuclear Waste Policy
Act of 1982 (NWPA), as amended, 42 U.S.C. 10222(a)(4), I hereby propose, subject to any
