This appendix responds to the issues raised by Federal, State, and local governments, affected Indian Tribes, private citizens, and other organizations on the draft environmental assessment (EA) that was prepared pursuant to Section 112 of the Nuclear Waste Policy Act of 1982 (the Act). In addition to presenting the issues raised in the comments and the responses, it describes where changes were made in the final EA.
The purpose of the report, which is authored by the three project leaders, is to provide a constructive starting point for the political dialogue that is necessary to achieve environmental law reform. The report builds on many of the ideas discussed at the March 2008 conference, but it is not a synthesis of these ideas, and indeed conference participants may disagree with aspects of the report.
Dealing with the problems posed by nuclear waste management is a major issue confronting continued use of the nuclear fuel cycle. Large amounts of radioactive wastes have already been generated as a result of past nuclear reactor operations, but these wastes are being temporarily kept in aboveground storage facilities awaiting a government policy decision on final disposition. Although research on various technologies to dispose of radioactive wastes is given high priority, a commercial waste disposal facility is not expected to be in operation before 1985.
The disposal and siting of hazardous and radioactive wastes has created numerous problems for decision-makers in the field of waste management. The social/political problems have proven to be some of the most difficult to solve. Public knowledge of the presence of hazardous and radioactive waste sites has grown considerably in recent years. Over the same period, the process of choosing new disposal sites has attracted a great deal of publicity.
The Nuclear Regulatory Commission (NRC) is publishing licensing criteria for disposal of spent nuclear fuel and high-level radioactive wastes in the proposed geologic repository at Yucca Mountain, Nevada. As mandated by law, this final rule changes the CommissionÕs technical requirements and criteria, as necessary, to be consistent with final environmental standards for Yucca Mountain issued by the U.S. Environmental Protection Agency (EPA).

The destructive examination results of five light water reactor rods from the Turkey Point Unit 3 reactor are presented. The examinations included fission gas collection and analyses, burnup and hydrogen analyses, and a metallographic evaluation of the fuel, cladding, oxide, and hydrides. The rods exhibited a low fission gas release with all other results appearing representative for pressurized water reactor fuel rods with similar burnups (28 GWd/MTU) and operating histories.
This report describes the characterization plan, methods, and results for light water reactor (LWR) Materials Characterization Center (MCC) spent fuel Approved Testing Material (ATM)-101. ATM-101 is spent fuel from H. B. Robinson, Unit 2, Assembly B0-5, a moderate-burnup, pressurized water reactor (PWR) fuel that released very small quantities of fission products and fission gas from the fuel during commercial operation.

The Nuclear Regulatory Commission (NRC) is publishing technical criteria for disposal of high-level radioactive wastes (HLW] in geologic repositories, as required by the Nuclear Waste Policy Act of 1982. The criteria address siting, design, and performance of a geologic repository, and the design and performance of the package which contains the waste within the geologic repository. Also included are criteria for monitoring and testing programs, performance confirmation, quality assurance, and personnel training and certification.

This paper explores the relationship between the national environmental movement and nuclear technology in relation to a local emergent group. The historical development of nuclear technology in this country has followed a path leading to continued fear and mistrust of waste management by a portion of the population. At the forefront of opposition to nuclear technology are people and groups endorsing environmental values.
The problem of isolating radioactive wastes from the biosphere presents specialists in the fields of earth sciences with some of the most complicated problems they have ever encountered. This is especially true for high level waste (HLW) which must be isolated in the underground and away from the biosphere for thousands of years.

The Environmental Protection Agency (EPA) has promulgated amendments to its public health and safety standards for radioactive material stored or disposed of in the potential repository at Yucca Mountain, Nevada (40 CFR Part 197). Section 801 of the Energy Policy Act of 1992 [(EnPA, Public Law 102-486, 42 U.S.C. § 10141 n. (1994)] directed EPA to develop these standards.

On September 30, 2008, the Environmental Protection Agency (EPA) issued the long-awaited revision to its 2001 Public Health and Safety Standard for the proposed Yucca Mountain deep geologic repository for high-level radioactive waste and spent nuclear fuel. While the issuance of the standard allows the Nuclear<br/>Regulatory Commission (NRC) to issue its final conforming standards and move forward toward a final license decision for the facility, EPA’s standard raises several unprecedented regulatory issues and is likely to be further challenged in court.
In the November 1989 Report to Congress on Reassessment of the Civilian Radioactive Waste Management Program (DOE/RW-0247), the Secretary of Energy announced an initiative for developing a monitored retrievable storage (MRS) facility that is to start spent-fuel acceptance in 1998. This facility, which will be licensed by the U.S. Nuclear Regulatory Commission (NRC), will receive spent fuel from commercial nuclear power plants and provide a limited amount of storage for this spent fuel.
