Dear Tim:
As we work to complete our final recommendations to the Secretary by January 29, 2012,
we have determined that our efforts would be aided by the formation of an ad hoc
subcommittee to investigate the issue of co‐mingling of defense and commercial wastes.
Specifically, the ad hoc subcommittee would review and make a recommendation to the
Commission on the issue of whether the 1985 Presidential decision to co‐mingle defense
and commercial wastes for disposal should be revisited in light of changes that have

At our request, the Commission staff is in the process of assembling information on the costs and financing of the US program to manage used fuel and high-level nuclear wastes. To assist in the completion of this effort, it would be most helpful if the Department could provide the information listed int the attachment.

At the request of the staff to the Blue Ribbon Commission on America’s Nuclear Future (“BRC”), we have reviewed the following questions:
1. Is there legal authority for DOE or any other entity to undertake to site a repository for “co-mingled” nuclear materials (i.e., civilian and defense spent nuclear fuel (SNF) and high-level radioactive waste (HLW)) at any site other than Yucca Mountain?
The American Nuclear Society (ANS) supports the safe, controlled, licensed, and regulated interim
storage of used nuclear fuel (UNF) (irradiated, spent fuel from a nuclear power reactor) until disposition
can be determined and completed. ANS supports the U.S. Nuclear Regulatory Commission’s (NRC’s)
determination that “spent fuel generated in any reactor can be stored safely and without significant
environmental impacts for at least 30 years beyond the licensed life for operation.
The nuclear energy industry is committed to legislative reform to create a sustainable, integrated program for federal government management of the Department of Energy’s (DOE) high-level radioactive waste and commercial used nuclear fuel.
The American Nuclear Society (ANS) supports (1) the development and use of geological
repositories for disposal of high-level radioactive wastes and (2) expeditious processing of the
Yucca Mountain license application in an open, technically sound manner. Geological disposal
means placing the wastes hundreds of feet underground and far from the biosphere. The U.S.
