This paper provides a brief description of the United States Nuclear Regulatory Commission (NRC) and its regulatory process for the current nuclear fuel cycle for light water power reactors (LWRs). It focuses on the regulatory framework for the licensing of facilities in the fuel cycle. The first part of the paper provides an overview of the NRC and its regulatory program including a description of its organization, function, authority, and responsibilities.
The Monitored Geologic Repository (MGR) Waste Package Project of the BSC Management and Operating Contractor for the Department of Energy's Office of Civilian Radioactive Waste Management performed calculations to provide input for disposal of spent nuclear fuel (SNF) from the Enrico Fermi Reactor owned by the DOE (Ref. 9). The Fermi SNF has been considered for disposal at the proposed Yucca Mountain site.
In July 1999, the U.S. Nuclear Regulatory Commission (NRC) Spent Fuel Project Office
(SFPO) issued Interim Staff Guidance 8 Revision 1 (ISG8R1) to provide recommendations for the use
of burnup credit in storage and transport of pressurized-water reactor (PWR) spent fuel. Subsequent to
the issuance of ISG8R1, the NRC Office of Regulatory Research (RES) has directed an effort to
investigate the technical basis for extending the criteria and recommendations of ISG8R1 to allow

Passed in 1982, the Nuclear Waste Policy Act (NWPA) was an effort to establish an explicit statutory basis for the Department of Energy (DOE) to dispose of the nation’s most highly radioactive nuclear waste. The NWPA requires DOE to remove spent nuclear fuel from commercial nuclear power plants, in exchange for a fee, and transport it to a permanent geologic repository or an interim storage facility before permanent disposal. Defense-related high-level<br>waste is to go into the same repository.

The Nuclear Regulatory Commission (NRC) is publishing technical criteria for disposal of high-level radioactive wastes (HLW] in geologic repositories, as required by the Nuclear Waste Policy Act of 1982. The criteria address siting, design, and performance of a geologic repository, and the design and performance of the package which contains the waste within the geologic repository. Also included are criteria for monitoring and testing programs, performance confirmation, quality assurance, and personnel training and certification.

We, the Environmental Protection Agency (EPA), are proposing to revise certain of our public health and safety standards for radioactive material stored or disposed of in the potential repository at Yucca Mountain, Nevada. Section 801(a) of the Energy Policy Act of 1992 (EnPA, Pub. L. 102Ð 486) directed us to develop these standards. These standards (the 2001 standards) were originally promulgated on June 13, 2001 (66 FR 32074).
EPA held a 90-day public comment period for the proposed radiation protection standards for Yucca Mountain (August 27, 1999 through November 26, 1999). Sixty-nine (69) sets of written comments were submitted to EPAÕs Air Docket regarding the proposed standards, although some commenters submitted more than one set of written comments. In addition, the Agency received oral testimony on the proposed standards from 28 speakers during public hearings that were held in Washington, DC; Las Vegas, NV; Amargosa Valley, NV; and Kansas City, MO.
This final rule incorporates compliance criteria applicable at different times for protection of individuals and in circumstances involving human intrusion into the repository. Compliance will be judged against a standard of 150 microsieverts per year (_Sv/yr) (15 millirem per year (mrem/yr)) committed effective dose equivalent (CEDE) at times up to 10,000 years after disposal and against a standard of 1 millisievert per year (mSv/yr) (100 mrem/yr) CEDE at times after 10,000 years and up to 1 million years after disposal.

This report examines the current policy, legal, and regulatory framework pertaining to used nuclear fuel and high level waste management in the United States. The goal is to identify potential changes that if made could add flexibility and possibly improve the chances of successfully implementing technical aspects of a nuclear waste policy. Experience suggests that the regulatory framework should be established prior to initiating future repository development.
We, the Environmental Protection Agency (EPA), are promulgating public health and safety standards for radioactive material stored or disposed of in the potential repository at Yucca Mountain, Nevada. Section 801 of the Energy Policy Act of 1992 (EnPA, Pub. L. 102Ð486) directs us to develop these standards. Section 801 of the EnPA also requires us to contract with the National Academy of Sciences (NAS) to conduct a study to provide findings and recommendations on reasonable standards for protection of the public health and safety.
DOE hereby amends the policies under the Nuclear Waste Policy Act of 1982 for evaluating the suitability of Yucca Mountain, Nevada, as a site for development of a nuclear waste repository. TodayÕs final rule focuses on the criteria and methodology to be used for evaluating relevant geological and other related aspects of the Yucca Mountain site.
After an exhaustive review process that encompassed EPAÕs proposed rule, as presented in the Federal Register Notice, as well as the reference materials cited in that Notice, Nevada concludes that EPAÕs proposed standard is inconsistent with the recommendations of the National Academy of Sciences (as required by the Energy Policy Act of 1992) and the July 9, 2004 ruling of the U.S. Circuit Court of Appeals for the District of Columbia.
Management of civilian radioactive waste has posed difficult issues for Congress since the beginning of the nuclear power industry in the 1950s. Federal policy is based on the premise that nuclear waste can be disposed of safely, but proposed storage and disposal facilities have frequently been challenged on safety, health, and environmental grounds.
